Discovery is the process through which parties demand information from one another and turover information demanded of them. Electronic discovery, or e-discovery, is a relatively new area of discovery that, along with technology, has grown rapidly. Parties who fail to turnover discovery can face consequences from the court, and this article makes the case for a new rule to be added to the Federal Rules of Evidence to empower Federal courts to hold parties accountable for failing to turn over e-discovery.
