Evidence: All the means legally presented at trial to persuade the court or jury as to the truth of a matter in question. Evidence includes testimony by witnesses, records, photographs, and exhibits. Although 'evidence' and 'proof' are used interchangeably, there is a distinction between the terms: 'Evidence' is the means by which the truth or falsity of a matter is established, and 'proof' is the result of evidence, although not all evidence establishes proof.
